يهدف البحث إلى معرفة معنى السنة القمرية والسنة الشمسية، وذكر الفروق بينهما، ودراسة المسائل الفقهية المتعلقة بالسنتين القمرية والشمسية، وبيان هل يصح العمل بغير السنة القمرية؟ وإذا كان العقد مبنيا على سنة مطلقة فهل تحمل السنة المطلقة على السنة القمرية أم الشمسية؟ وقد اشتمل البحث على مقدمة وتمهيد ومبحثين وخاتمة، فكان المبحث الأول في الفرق بين السنة القمرية والسنة الشمسية وفيه أحد عشر مطلبا، والمبحث الثاني في المسائل الفقهية المتعلقة بالسنتين القمرية والشمسية وفيه اثنا عشر مطلبا، واقتصرت على كتب المذاهب الأربعة، مع بيان صورة المسألة، وذكر الأقوال والأدلة، وبيان الراجح منها، وتوصل الباحث إلى نتائج أهمها: أن السنة القمرية هي السنة الشرعية المعتبرة لدى المسلمين في حساب السنين، وإذا وردت السنة أو العام أو الحول في كتاب الله أو في سنة رسوله-صلى الله عليه وسلم-فإن المراد السنة القمرية؛ لأنها السنة الشرعية ولا عبرة بالسنة الشمسية في ذلك، وإذا كانت السنة مطلقة فتنصرف إلى السنة القمرية لأنها السنة المعتبرة شرعا، سواء أكان الإطلاق عند الفقهاء أو بين أطراف العقد، وإذا لم يرد تحديد السنة من الشارع في الأحكام الشرعية كمدة الإجارة والسلم وغيرها من المعاملات المالية فيصح العمل بغير السنة القمرية إذا علمها جميع أطراف العقد واتفقوا على ذلك وهو الراجح، والسنة القمرية هي المعتبرة في حول الخراج على مساحة الأرض، وتعتبر السنة الشمسية لحول الخراج على مساحة الزرع وهو الراجح، والسنة القمرية هي المعتبرة في حول الزكاة وهو الراجح، وتؤخذ الجزية في كل سنة قمرية مرة واحدة وهو الراجح، ويصح السلم بالسنة الشمسية وهو الراجح، ويصح عقد الإجارة على السنة الشمسية وعلى غيرها بشرط عدم جهل أحد المتعاقدين بالمدة وهو الراجح، وتعرف اللقطة سنة قمرية، ويؤجل العنين سنة قمرية وهو الراجح، ويصح تعليق الطلاق على السنة الشمسية وهو الراجح، والرضاع المؤثر ما كان في الحولين وتعتبر السنة القمرية في حساب الحولين وهو الراجح، ويغرب الزاني البكر سنة قمرية، ومن التوصيات: العناية بالدراسات الشرعية المتعلقة بالآيات الظاهرة، كالليل والنهار والنجوم والبحار وغيرها، وجمع المسائل التي لها تعلق بالآيات الكونية في مذهب معين، أو على مستوى المذاهب الأربعة.
