السنة المشهورة بين الحنفية والجمهور | The well-known prophetic Sunnah between Alhanafya and The majority of Fuqaha

يهدف البحث إلى التأكيد على أهمية السنة المشهورة كقسم من أقسام السنة المتصلة، وبيان ماهيتها ، وضابط الشهرة عند العلماء، وأنها عكس الشذوذ ، وبيان حكم السنة المشهورة من حيث:  إفادتها للعلم، والعمل بها، وعلاقتها بالقرآن الكريم، وبيان أثرها في الفروع الفقهية. وإلى بيان مدى حرص الحنفية على تحري الصحيح من الأحاديث النبوية، وأنهم برآء مما يتهمهم به البعض من تقديمهم الرأي على الحديث النبوي.
 
  اتبعت في البحث منهج الاستقصاء والتحليل، وجمعت مادته العلمية من مصادرها الأصلية، وعزوت النصوص القرآنية الكريمة إلى مواطنها من القرآن الكريم، وخرجت الأحاديث النبوية الشريفة، وترجمت لمن يحتاج ترجمة من الأعلام، وبينت مذاهب العلماء وسقت أدلتهم، ورجحت ما رأيته راجحا ، وبينت المسائل ببعض الفروع المبنية عليها .
 وانتهى البحث إلى أن السنة المشهورة هي ما كان آحادا في عصر الصحابة ثم تواتر بعدهم؛ فلم تصل إلى حد التواتر، وأنها عند الحنفية قسم مستقل من أقسام السنة المتصلة السند إلى رسول الله صلى الله عليه وسلم، وعند الجمهور داخلة في الآحاد، وأن مدار الشهرة على تلقي العلماء الحديث بالقبول واتفاقهم على العمل به ، وأن السنة المشهورة عند الحنفية تفيد علم الطمأنينة لا اليقين، فهي فوق الآحاد ودون المتواتر ؛إلا أنها تعمل عمل المتواتر فتخصص القرآن وتقيده ويزاد بها عليه ، وأن الحنفية امتازوا بهذا التقسيم الذي ظهر أثرة في الفروع الفقهية.

The research aims to emphasize the importance of well-known Sunnah as a section of the Prophet's frequent Sunnah, explaining its nature and the rules of fame (well-known) according to Fuqaha, and it is opposite of anomaly, clarification of the Judgment of the well-known Sunnah on the one hand: Its feedback for knowledge and practice, its relationship with the Holy Koran, and its impact on the jurisprudential branches. Clarification of how Alhanafya are very keen to investigate and select the most correct from the prophet's hadiths. They are innocent of what some ignorant people accuse them of presenting opinion on prophetic hadiths.
In this research, I have been following the survey and analysis approach, collecting its scientific material from its original sources, showing the doctrines of scholars and their evidence. I consider what I have seen more likely. I have clarified issues in some of the sections on which they are based.
The research concluded that the well-known prophetic Sunnah is what was unilateral in the age of the companions and then has become frequent after them; and it has not reached the point of frequency. And according to Alhanafya it is a separate section of the Sunnah related to frequent Sunnah to the Prophet (PBUH).
According to the majority of Fuqaha; it is related to unilateral, and the fame is for Fuqaha's acceptance of Hadeth and their agreement to use it. The well-known prophetic Sunnah means the knowledge of reassurance, and it is less frequent and above unilateral.
Alhanafya are privileged by this division, which has shown an effect in the jurisprudential branches.
