مبادئ علم نوازل الحسبة دراسة تأصيلية / Principles of Nawazel El-Hisbah Science- Fundamental Study

هدف البحث إلى: بيان مفهوم المبادئ العشرة وأهميتها في علم نوازل الحسبة، ومعرفة حد العلم وموضوعه وثمرته، وإيضاح اسمه واستمداده وحكمه، وكذلك التعرف على فضله ونسبته وواضعه ومسائله، واتبع الباحث: المنهج الاستقرائي، ومن أهم النتائج: أن تعريف "علم نوازل الحسبة" مركبًا هو: (مجموع مسائل وأصول الوقائع الجديدة المستدعية للاجتهاد الشرعي في شأن الوظيفة الدينية القائمة بالنظر في أمور الناس الظاهرة وتدبيرها تحقيقًا لمبدأ الأمر بالمعروف والنهي عن المنكر)، ومن ثمراته: أن اعتناء الناظر بهذا العلم وتحصيل أصوله والتدرب على مسائله يسهم في تكوين ملكته الفقهية والعلمية ويعطيه مهارة في معالجة مشكلات الحسبة النازلة، ويستمد من: علمي الكتاب والسنة، وعلم أصول الفقه، وعلم الحسبة، وواضعه: في مجاله التأصيلي كاتب هذه الأسطر -عفى الله عنه- في رسالته العلمية الموسومة بـ"فقه نوازل الحسبة وتطبيقاته المعاصرة لدى الجهات المعنية في المملكة العربية السعودية"، ومن مسائل العلم: شروط الناظر في نوازل الحسبة، وآدابه، وأنواعه، وشروط القضايا المنظور فيها بنوازل الحسبة، وأسبابها، ومراحل النظر في نوازل الحسبة، ومن أهم التوصيات: دراسة فكرتي: مبادئ علم النوازل أو علم فقه النوازل دراسة تأصيلية، وإعمال قواعد الشريعة في نوازل الحسبة دراسة تأصيلية تطبيقية، وكذلك تضمين المقررات المتعلقة بـ"نوازل الحسبة" مفردات عن مبادئ علم نوازل الحسبة.
The research aims to: clarify the concept of the ten principles and their importance t Nawazel El-Hisbah Science, and to know the extent of the science, its subject and its benefit, and to clarify its name, its derivation and its ruling, as well as to identify its merit, its attribution, its founder and its issues. The researcher followed the inductive approach, and among the most important results: The definition of “Nawazel El-Hisbah” is: (The sum of the issues and principles of new facts that call for legal ijtihad regarding the religious function based on looking into people’s apparent affairs and managing them in order to achieve the principle of enjoining good and forbidding evil), and among its benefits: The seeker interest in this science and obtaining its principles and training on its issues contributes to forming his jurisprudential and scientific ability and gives him skill in dealing with the problems of the emerging Hisbah, and he derives from: the science of the Qur’an and Sunnah, the science of the principles of jurisprudence, and the science of Hisbah, and its founder: In its fundamental field, the writer of these lines - may God forgive him - in his scientific thesis entitled “Fiqh of Nawazil al-Hisbah and its contemporary applications among the concerned authorities in the Kingdom Saudi Arabia”, and among the issues of knowledge: the conditions of the seeker in the incidents of Hisbah, its etiquette, its types, the conditions of the cases considered in the incidents of Hisbah, their causes, and the stages of considering the incidents of Hisbah . Among the most important recommendations: Studying my idea: the Principles of Nawazel science or the science of Nawazel jurisprudence, fundamental study, and applying the rules of Sharia in Nawazel El-Hisbah, applied fundamental study, as well as including in the curricula related to “Nawazel El-Hisbah” vocabulary about the principles of Nawazel El-Hisbah science.
